Terms of Service
1. Acceptance of These Terms
By clicking "Get My Report," starting the assessment, or otherwise using our leadership assessment tool (the "Assessment"), you agree to these Terms of Service (the "Terms") and our Privacy Policy. If you do not agree, do not use the Assessment.
2. What the Assessment Is — and What It Is Not
The Assessment is a self-development tool. It asks you a series of survey questions about your working habits, leadership tendencies, and current state, and scores your answers into a personalized "archetype" and "depletion stage," delivered to you as a PDF report if you choose the identified path, or shown to you directly if taken anonymously. It is designed to give you a framework for thinking about your own leadership style and current capacity, for your own reflection and development.
The Assessment is not any of the following, and you should not treat it as any of the following:
- It is not a clinical, psychological, medical, or diagnostic instrument. It is not designed, validated, or administered by a licensed healthcare professional, psychologist, or clinician, and it does not diagnose any medical or mental health condition. If you have concerns about your mental or physical health, please consult a qualified healthcare professional. The Assessment is not a substitute for that consultation.
- It is not scientifically validated in the way a clinical psychometric instrument is. We do not represent it as such, and you should not rely on it as such.
- No employment, hiring, promotion, termination, compensation, or other employment-related decision should be made based on this Assessment, whether about yourself or anyone else. The Assessment was not designed or validated for use in employment decision-making, and using it for that purpose falls entirely outside its intended use.
- It is not professional coaching, therapy, or consulting advice by itself. It is a starting point that may inform a broader conversation with us or with a qualified professional of your choosing, but the report alone is not a substitute for that conversation.
3. Anonymous and Identified Assessment Paths
You may take the Assessment anonymously, without providing your name, email, or any other identifying information, or you may choose to provide your email address, and any name field offered, to receive your personalized PDF report and, if you separately consent, to be added to our marketing communications. Which path you take is your choice. See our Privacy Policy for how each path is handled with respect to your data.
4. Intellectual Property
The Assessment, including its questions, scoring methodology, the "archetype" and "depletion stage" taxonomy, and the design and content of the resulting report, is the property of Trajectory Enterprise LLC, protected by applicable intellectual property law, and is not licensed to you for any purpose beyond your own personal use of your own report.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable license to view, download, and use your own personalized report for your own personal or internal business reference. You may not:
- reproduce, distribute, publish, or resell the Assessment questions, scoring methodology, or report template;
- reverse-engineer, decompile, or otherwise attempt to derive the scoring logic behind the Assessment;
- use the Assessment, its questions, or its output to build, train, or inform a competing product or service;
- represent the Assessment or its output as your own work product or as validated by anyone other than us.
If you took the Assessment as part of a group assessment organized by Trajectory, these Terms govern your individual use of the Assessment as a participant in the same way they govern any other use. See our Privacy Policy for how group assessment data is handled.
5. Acceptable Use
You agree to use the Assessment only for its intended purpose and agree not to:
- provide false or misleading information with the intent to disrupt or manipulate the Assessment's operation (this does not restrict your right to decline to answer honestly or to take the Assessment anonymously — it addresses attempts to abuse or break the tool itself);
- use automated means (bots, scripts) to access or submit the Assessment at scale without our prior written permission;
- attempt to gain unauthorized access to our systems, other users' reports, or any non-public part of the Assessment infrastructure;
- use the Assessment in any way that violates applicable law.
6. No Warranties
THE ASSESSMENT AND ANY REPORT GENERATED FROM IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY ILLINOIS LAW. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH DISCLAIMER IS PERMITTED BY ILLINOIS LAW. WE DO NOT WARRANT THAT THE ASSESSMENT WILL BE ACCURATE, UNINTERRUPTED, ERROR-FREE, OR THAT ANY RESULT, ARCHETYPE, OR DEPLETION-STAGE SCORE IT PRODUCES WILL BE CORRECT OR SUITABLE FOR ANY PARTICULAR PURPOSE.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY ILLINOIS LAW, TRAJECTORY ENTERPRISE LLC AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE ASSESSMENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
BECAUSE THE ASSESSMENT IS PROVIDED FREE OF CHARGE, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE ASSESSMENT IS LIMITED TO ONE HUNDRED DOLLARS ($100.00).
Nothing in these Terms limits liability to the extent such a limitation is not permitted under applicable law.
8. Governing Law and Venue
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Assessment will be brought exclusively in the state or federal courts located in Cook County, Illinois.
9. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date above reflects the most recent version. If we make material changes, we will provide reasonable notice, for example by updating this page and, where practical, noting the change prominently on our website. Your continued use of the Assessment after a change takes effect means you accept the updated Terms. If you do not agree to updated Terms, your only recourse is to stop using the Assessment.
10. Termination
We may suspend or discontinue the Assessment, or your access to it, at any time, for any reason, including for violation of these Terms.
11. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Assessment. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign your rights under these Terms.
